In granting bail to Benoy Babu, the Regional General Manager, the top court expressed a pointed opinion, stating, “Prolonged pretrial detention is not acceptable; holding individuals in custody for extended periods before a trial is inappropriate.”

“… The outcome remains uncertain. There appears to be a contradiction between the allegations made by the Central Bureau of Investigation and those made by the Enforcement Directorate,” observed Justice Sanjiv Khanna.

The bench, comprising Justice SVN Bhatt, directed the release of Mr. Babu, acknowledging his 13-month imprisonment and considering the factual circumstances presented in his application.

Numerous individuals have been apprehended in relation to this case, sparking a significant political dispute between the ruling BJP and the opposition, particularly the Aam Aadmi Party, which holds power in Delhi. Two prominent AAP members, former Delhi Deputy Chief Minister Manish Sisodia and Rajya Sabha MP Sanjay Singh, have been detained in connection with this matter.

Mr. Sisodia has been incarcerated since February, while Mr. Singh has been in detention since October.
